Brief description of the case law of the Cypriot Courts regarding general compensation for neck and minor injuries
In the case of Stelios Antoniou v. Andrias Savvidou Case No. 2119/2009 dated 4/3/2015, the Plaintiff suffered a neck sprain without any pathological remains. The court granted the amount of €2,000 for general damages for pain and suffering.
In the case of lordanis lordanous v. Alena Doromina Case No. 5495/2007 dated 17/9/2012, the Plaintiff suffered left shoulder, cervical spine and left ankle distortion as well as sprain of the soft tissue of the thoracic spine. The court granted the amount of €2,500 for general damages for pain and suffering, at full responsibility.
In the case of 1. Nicos Papadouri 2. Giannas Papadouri v. Christou Charalambous 2. Louka Stylianou Case No. 529/2016 dated 22/5/2017, the Plaintiff suffered brain concussion, severe neck distortion, left shoulder, thoracic and lumbar sprain. The court granted the amount of €2,500 for general damages for pain and suffering.
In the case of Chrystalla Christofi v. 1. Ntinou Constantinou 2. Motor Insurer’s Fund Case No 2772/2015 dated 14/1/2016, the Plaintiff suffered whiplash/distortion of the cervical spine, lumbar spine and thorax. The court, taking into account the possibility for the Plaintiff to develop post-traumatic arthritis in the future, granted the amount of €3,000 for general damages for pain and suffering.
In the co-litigation lawsuits Harmworth June and Others ν. Salamis Glory and Others (2003) 1 CLR 1617 dated 7/11/2003, one of the Plaintiffs suffered a sprain of the neck and lower back, hematoma of the left thigh and sprain of the abdominal wall. The court granted the amount of CYP 2,500.00 for general damages. Another one of the Plaintiffs suffered lumbar spine sprain and had lower back pain and stiffness for a long time, especially after fatigue. The Court awarded the amount of CYP 2,000 for general damages for pain and suffering.
In the case of Panagiotis Zeniou v. Andris Thouki Case No 3487/2008 dated 16/4/2014, the Plaintiff suffered sprain and distortion of the cervical and lumbar spine, felt severe pain in the limitations of neck and lumbar mobility, endured painful bruises and extensive swelling of the nose and its soft tissues, experienced headaches and dizziness. The court granted the amount of €3,500 for general damages for pain and suffering.
In the case of Konstantinos Oratiou v. Andreas Polykarpou Case No 4057/2009 dated 16/9/2016, the Plaintiff suffered severe neck and lumbar strain/whiplash which he treated with 30 physiotherapies, anti-inflammatory drugs and cervical collar. The court granted the amount €6,000 for general damages for pain and suffering.
In the case of Panagiota Lambrou Christodoulou v. Panormitis Mouzouraki Case No 2284/10 dated 29/8/2016, the Plaintiff suffered a craniocerebral injury, severe neck sprain and had instability in gait, mild whiplash of the cervical spine, clavicle thoracic sprain and injury with swelling of the right elbow. The court granted the amount of €8,000 for general damages for pain and suffering.
In the case of Konstantinos Konstantinidis v. Militsas Papamiltiadou and Others (2007) 1 CLR 733 dated 14/7/2007, the Defendant-Plaintiff suffered fracture of the 5th rib, cervical distortion and brain concussion. He used a cervical collar for 3 months and stayed out of work for about 2 months. Radiologically he was completely healed. Some neck sensitivity remained during weather change. The court granted the amount of CYP 5.000,00 (€8.547,98) for general damages for pain and suffering.
In the case of Christina Georgiou vs Kyriaki Neophytou Case No 1186/11 dated 3/8/2017, the Plaintiff suffered neck and lumbar sprain, chest injury and a rupture of the upper lip cartilage of the right shoulder. He underwent surgery and had a right shoulder arthroscopy to clear the SLAP rupture and an arthroscopicacromioplasty. The court granted the amount of €18.000 for general damages for pain and suffering.
In the case of Neocleous v Worley (2001) 1A CLR 652 dated 24/5/2001, the Defendant, among other injuries, suffered sprain of the soft tissues of the cervical spine with numbness of the hands, painful and limited neck movements, with the symptoms lasting for a period up to 6 months after the accident. The district court granted the amount of CYP 2.000,00 for general damages which on appeal were increased to CYP 3.500,00.
In the case of Despina Christodoulou v. Rudolf Hoffer, Appeal No. 263/2012 dated 1/11/2018, the Plaintiff suffered post-traumatic syndrome after a whiplash injury, an injury in the chest area and swelling in the chin. The court granted the amount of €4,500 for general damages for pain and suffering.
